Welcome to MyGenie.live! These Terms of Service ("Terms") govern your use of MyGenie.live, an innovative social app created by MyGenie.live INC, and powered by Generative Artificial Intelligence (GenAI) that enables virtual video conversations with personalized Genies. Please carefully read and understand these Terms before using the service.

Acceptance of Terms
By contributing to, accessing, or using the MyGenie.live website or mobile app, you agree to comply with and be bound by these Terms. If you do not agree with any part of the Terms, you may not use the service.
Description of the Service
MyGenie.live allows users to engage in virtual video conversations with their favorite people or influencers ("Genies") and optionally share these conversations with the public. Users can invite friends to become their Genies, share their conversations, and discover other public conversations.

Genies as Users
​
Genies, including influencers and individuals creating Genies, are integral users of MyGenie.live. By becoming a Genie, you acknowledge and agree to the following terms:

Termination and Changes
​
i. MyGenie.live reserves the right to modify terms with prior notice, and any changes will be communicated to you.

Compliance with App Policies
i. As a Genie, you agree to comply with MyGenie.live's content policies, code of conduct, and any other guidelines outlined in the Terms and Conditions of Service.

Intellectual Property
​
i. By using MyGenie.live or by becoming a Genie on the platform, users acknowledge and agree that all content generated by digital Genies, including but not limited to AI-based conversations, text, images, and any other multimedia elements, are the exclusive intellectual property of MyGenie.live. Users retain no ownership rights over such content, and hereby grant MyGenie.live a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in any form, media, or technology now known or later developed for the purposes of enhancing the user experience within the MyGenie.live platform. This includes the generation and dissemination of AI-based content spoken by digital Genies.

ii. MyGenie.live retains ownership of the content users generate on MyGenie.live. Users, including Genies on the platform, grant MyGenie.live a global, non-exclusive, royalty-free license to use, reproduce, and distribute their content for the purposes of enhancing the user experience.

iii. MyGenie.live will utilize Artificial Intelligence (AI) technologies, including Large Language Models (LLMs) such as ChatGPT, to improve and personalize the user experience.

Confidentiality
​
i. Any confidential information shared between you and MyGenie.live will be treated in accordance with the confidentiality provisions specified in the individual agreement.

Indemnity
​
i. You agree to indemnify and hold MyGenie.live harmless from any claims, damages, liabilities, and expenses arising out of or in connection with your use of the service, including but not limited to any breach by you of these Terms.

User Obligations and Conduct
​
i. Users agree to use MyGenie.live for personal, non-commercial purposes and to comply with the code of conduct outlined in these Terms.
ii. Respectful and inclusive communication is encouraged. Any form of harassment, hate speech, or inappropriate content is strictly prohibited.
iii. Users shall not engage in activities that interfere with the normal functioning of MyGenie.live or its servers.

Payment Plans

i. MyGenie.live offers multiple payment plans, providing ability to converse with genies.
​
Cancellation and Refunds
​
i. Payment plan that a user is on can be changed at any time, with future applicability.
ii. There are no refunds for payments already made.

Privacy and Data Handling
i. Users consent to the collection, storage, and processing of personal information as described in MyGenie.live's Privacy Policy.
ii. Genies may have specific agreements regarding the handling of their personal information, and users agree to abide by these terms.

Virtual Use Limitation and Liability
​
i. MyGenie.live shall not be liable for any unexpected virtual use of Genies by users who publish conversations with Genies on the App or outside the app. Users and Genies use the platform with the understanding that shared content may be used as intended by the platform features.

Termination of Service
​
MyGenie.live reserves the right to suspend or terminate user access to the service without notice for any violation of these Terms or inappropriate behavior on the platform.

Changes to Terms
​
i. MyGenie.live may modify these Terms at any time. Continued use of the service after modifications constitutes acceptance of the updated Terms.

Dispute Resolution
​
i. These Terms shall be governed by and construed in accordance with the laws of the State of California and the United States.
ii. Any dispute arising out of or in connection with these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association or the International Chamber of Commerce, as applicable.
iii. The arbitration shall take place in California, USA, and shall be conducted in English.
iv. The prevailing party in any arbitration or legal action is entitled to recover its reasonable attorneys' fees and costs.
